Overview
The Defence Force Discipline (RCDVS Implementation and Related Measures No. 1) Transitional Rules 2026 came into force on 6 October 2026. This legislative instrument is administered by the Department of Defence.
What the instrument covers
The instrument sets out transitional rules for military disciplinary proceedings in three specific areas:
- How new rules of procedure apply to proceedings that were already underway before the relevant parts of the Act commenced.
- Limits on detention periods for people detained under section 194 before a specific part of the Act started.
- How pre-commencement detention time is counted when mental health orders are being considered.
