Overview
The federal Department of Health, Disability and Ageing has registered a new legislative instrument called the Health Insurance (Provider Numbers) Instrument 2026. The instrument took effect on 3 November 2026.
The instrument sets out which types of health professionals can apply for a Medicare provider number and the rules for allocating, suspending and lifting suspension of provider numbers, including when applications are made digitally.
Who This Affects
This mainly affects health practitioners and practices that rely on provider numbers to bill Medicare, such as medical practitioners, interns, dental practitioners, and other AHPRA-registered or non-AHPRA-registered health professionals.
Transitional Rules
There are transitional rules covering provider number matters that were already in progress or suspended before the instrument commenced. These are set out in Part 6 of the instrument.
Key Actions
- Medical practitioners, interns, dental practitioners or other health professionals who bill Medicare are advised to check whether their provider number status is affected by the new allocation or suspension rules in this instrument
- Those with a pending provider number application, suspension, or reconsideration decision from before 3 November 2026 can check the transitional rules in Part 6 to see how it is treated
- The full legislative text and explanatory statement are available at https://www.legislation.gov.au/F2026L01473 to see the specific criteria that apply to each professional category
- Practice managers and bookkeepers handling Medicare billing can confirm with practitioners that their provider number arrangements are still valid under the new rules
